Ajay Devgan Smoking Controversy in Chandigarh | Panchkula NGO Files Case | NewsTaking cognisance of a news report highlighting actor Ajay Devgan smoking at a public place, published in a section of the Press, activists of an NGO have filed a complaint against him with the police.

Hemant Goswami, chairperson of Burning Brain Society, who filed the complaint said: “We have filed a complaint with the SSP against Ajay Devgan after spotting his picture in a Hindi daily yesterday, where he was smoking in the passage of Chandigarh Airport.”

Chandigarh is a smoke-free city and anybody is liable to face action under the provisions of the Cigarettes and Other Tobacco Products Act.

The SSP, SS Srivastava, confirmed that a complaint in this regard had been received and the course of action would be decided later as per law.

The complaint said: “Even the in charge/manager of Chandigarh Airport failed to adhere to Rule 3 read with Section 4 of the Act for not displaying warning boards as prescribed under the Act and failed to check its violation.

“This attracts provisions of Section 21 of the Act. He should also be penalised for violating law,” a legal expert said. THE TRIBUNE SAID

Panchkula: Though a ban on smoking in public places was enforced on October 2, 2008, it has failed to take off in Panchkula as the district administration till now has fined only about five persons for violating it. However, a number of violators can be spotted on city roads.
Panchkula police and administration often start campaigns against drunken driving and overloaded autos, but have failed to act tough against those smoking in public place. The state government had issued a direction in October according to which, the DC is the enforcing authority. The officer has to monitor all public places and ensure the rules are followed.
A senior Panchkula police official said it was not easy to enforce the ban. “We have strict orders to fine those smoking at public places, like bus stops, but not many have been fined so far. It’s difficult to keep a tab on thousands of passengers who visit the place every day, moreover, we have to check other crimes as well.” Another police official said, “It is difficult for us, as a gazetted officer can issue the challan.”
Panchkula DC Rajinder Kataria told TOI that the administration would take initiatives for the proper implementation of the ban.
He said, “The administration is educating people and schoolkids to spread the no-smoking message in their houses and neighbourhood as well. We have written to hotels, restaurants and government and private offices in the district to implement the smoking ban at public places.” President of Citizens’ Welfare Association of Panchkula SK Nayyar said, “Panchkula administration should strictly implement the ban. Chandigarh: Although smoking at public places is banned, actor Ajay Devgan was caught on camera smoking at Chandigarh Airport on Monday. For it, he can face challan from the city police.
UT SSP Sudhanshu Shekhar Srivastava told TOI that they have asked deputy district attorney Dayanand Gautam to give his legal opinion on the issue by Wednesday. “Depending on it, we will take necessary action. If a person is caught smoking at a public place, Rs 200 fine can be imposed on him.” Notably, smoking at public places has been banned in the city since 20 months, and in the country since October 2, 2008. Recently, while shooting for film ‘Rab ne bana di jori’ at Khalsa College, Amritsar, Shahrukh Khan was spotted smoking, for which he even earned the ire of health minister Anbumani Ramadoss.
Hemant Goswami, a social activist who is also the force behind the city adopting nosmoking tag, has moved a formal complaint against the actor. The actor was reportedly told about the law, but allegedly he refused to abide by it. “I have pressed for immediate action and challan. The violation done by the actor is apparent and he must be challaned. There shouldn’t be any relaxation for an influential person,” Goswami said. The actor is here for a movie shoot.
UT among top four
Chandigarh administration is among the top four states and UTs in issuing challan slips for smoking in public places. According to the health ministry’s recent city-wise survey, Chandigarh has till now fined 920 violators.
What the rule states
Violators of the rule will be fined Rs 200. If caught, a violator can pay in cash against a printed challan. Those who do not pay the spot fine could face detention. However, there is no mechanism to detect repeat offenders and slap a higher fine.
Panels formed
The Haryana government on Tuesday constituted a 12-member state-level committee to implement the ban on smoking at public places. Besides, district-level committees were also constituted under the chairmanship of deputy commissioners (DC) and civil surgeons made their vicechairmen.
